The Service is provided as a tool to help manage and organize calibration and maintenance information. Users remain responsible for the accuracy, completeness, and compliance of all data entered into the system.
3. USER ACCOUNTS
To use certain features of the Service, you may be required to create an account.
You agree to:
- Provide accurate and complete information during registration.
- Maintain the security of your account credentials.
- Be responsible for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account.
4. ACCEPTABLE USE
You agree not to use the Service to:
- Violate any applicable laws or regulations.
- Upload or distribute harmful or malicious software.
- Attempt to gain unauthorized access to the Service or related systems.
- Interfere with the operation or security of the Service.
We reserve the right to suspend or terminate accounts that violate these rules.
5. DATA RESPONSIBILITY
Users are solely responsible for the data they input into the Service, including calibration records, inspection reports, equipment data, and certificates.
Calitrak does not verify or guarantee the accuracy of user-provided information. The Service should not replace professional judgment, regulatory compliance procedures, or required quality assurance processes.
6. INTELLECTUAL PROPERTY
All content, software, design, and features of the Service are the property of Calitrak and are protected by applicable intellectual property laws.
Users may not reproduce, distribute, modify, or create derivative works from the Service without prior written permission.
7. SERVICE AVAILIBILITY
We aim to provide reliable and uninterrupted access to the Service. However, we do not guarantee that the Service will always be available or free from errors.
Maintenance, updates, or technical issues may occasionally result in temporary interruptions.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Calitrak shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Service.
This includes, but is not limited to:
- Data loss
- Business interruption
- Inaccurate calibration records
- Operational decisions made based on the Service
9. TERMINATION
We reserve the right to suspend or terminate access to the Service at our discretion if these Terms are violated.
Users may discontinue use of the Service at any time.
10. DATA RETENTION AND DELETION
Calitrak retains personal and operational data only for as long as necessary to fulfill the purposes for which it was collected, including service delivery, legal, accounting, and audit requirements, in accordance with applicable laws, including PIPEDA.
Upon termination or closure of an account:
- Data associated with Professional accounts may be retained for up to eighteen (18) months.
- Data associated with all other account types may be retained for up to twelve (12) months.
These retention periods are considered reasonable to allow for:
- Exporting data they wish to retain following the account closure.
- Contractual and business record-keeping.
- Dispute resolution.
- Regulatory or audit requirements.
During the retention period, data will be securely stored and protected against unauthorized access, disclosure, or misuse.
After the applicable retention period expires, Calitrak will securely delete, anonymize, or irreversibly destroy the data, unless continued retention is required or permitted by law.
Users may request access to their personal data or request its deletion, subject to legal or contractual restrictions, by contacting us using the details provided in these Terms.
Users are responsible for exporting any data they wish to retain prior to account closure. Calitrak does not guarantee data availability after account termination.
11. CHANGES TO THE TERMS
We may update these Terms from time to time. When changes are made, the updated version will be posted on this page with a revised “Last updated” date.
Continued use of the Service after such changes constitutes acceptance of the updated Terms.
